Privacy Policy

This Privacy Policy describes how Hales Health Insurance (Hales Senior Care) (“we,” “us,” or “our”) collects, uses, and shares information about you when you use our website, client portal, and insurance services. Because we help with Medicare and ACA coverage, we handle your information under the federal Gramm-Leach-Bliley Act (GLBA) and applicable state insurance-privacy rules, under HIPAA where protected health information is involved, and consistent with the CMS Medicare Communications & Marketing Guidelines. There is never a cost to work with our agency.

1. Information We Collect

Information you provide directly:

  • Name, email address, phone number, and mailing address
  • Date of birth and gender
  • Medicare/Medicaid status and Medicare Beneficiary Identifier (MBI), when applicable
  • Health information you share so we can compare plans (e.g., conditions or prescriptions)
  • Household and income information needed to determine ACA subsidies and credits
  • Scope of Appointment and other consents you sign before a Medicare discussion
  • Account credentials (passwords are hashed and never stored in plain text)

Information collected automatically:

  • IP address and browser/device type (for security and fraud prevention)
  • Pages visited and actions taken on our site (via server logs)
  • Session cookies required for authentication

We do not use third-party tracking pixels, Google Analytics, or advertising cookies.

2. How We Use Your Information

  • Schedule and manage appointments and consultations with our agents
  • Compare plans, prepare quotes, and submit applications to carriers and exchanges (such as Your Health Idaho or HealthCare.gov) on your behalf and with your authorization
  • Send appointment confirmations, reminders, and service communications
  • Maintain your client record and the policies you enroll in
  • Meet our legal, regulatory, and CMS Medicare-marketing obligations

3. SMS Communications

We use SMS (text messaging) to send appointment reminders, enrollment-period and coverage deadlines, and direct communications from your agent. Message frequency varies. Standard message and data rates may apply.

How we obtain consent: You provide your mobile phone number when you request a consultation, create your client portal at haleshealthins.com, or speak with an agent by phone or in person. By providing your phone number, you consent to receive SMS messages from Hales Health Insurance related to your coverage and appointments.

Opt-out: You may opt out of SMS messages at any time by replying STOP to any message. You will receive a single confirmation message and no further SMS will be sent. To re-enable SMS, reply START.

No mobile information — including your phone number and your SMS opt-in or consent — will be shared with third parties or affiliates for marketing or promotional purposes. SMS consent is not a condition of receiving services or purchasing insurance.

4. How We Share Your Information

We share your information only in the following limited circumstances:

  • Carriers & exchanges: with the insurance carriers, Medicare, and marketplaces needed to quote, apply for, and service the coverage you choose to pursue, with your authorization.
  • Service providers: e.g., Amazon Web Services (SES) for email and Twilio for SMS appointment reminders. These providers access only the information necessary to perform their services and are bound by confidentiality obligations.
  • Legal requirements: we may disclose information when required by law, subpoena, or court order, or to protect the safety of our clients and staff.
  • Business transfers: in the event of a merger, acquisition, or sale of assets, client information may be transferred as part of that transaction, subject to this policy.

We do not sell your personal information, and we do not share it for third-party marketing.

5. Data Retention

We retain client records and policy history as required by Idaho and Missouri state law and applicable federal insurance and CMS regulations. Account credentials and session data are retained while your account is active. You may request deletion of your account and non-policy data at any time (see Section 8).

6. Data Security

We take reasonable technical and organizational measures to protect your information, including:

  • HTTPS encryption for all data in transit
  • Hashed passwords and authenticated, role-based access to client records
  • Access limited to the agents and staff who need it to serve you
  • Audit logging of access to client records

7. Cookies

We use only strictly necessary session cookies for authentication and security. We do not use advertising, tracking, or analytics cookies. You may disable cookies in your browser, but doing so will prevent you from logging in to your portal.

8. Your Rights

You have the right to:

  • Access a copy of the personal information we hold about you
  • Correct inaccurate or incomplete information
  • Delete your account and associated non-policy data (insurance records are retained as required by law)
  • Opt out of non-essential SMS and email communications
  • Request a copy of your health information under HIPAA

9. Children's Privacy

Our services are intended for adults making insurance decisions and are not directed to children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us immediately.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated policy on this page with a new “Last updated” date. Continued use of our services after such changes constitutes acceptance of the updated policy.
